Terms of Use and Conditions

The creator commits to carrying out the creative project following the management criteria and conditions that Aixeta, the Catalan continuous crowdfunding platform, specifies below. Having an account registered on L’Aixeta and acting as a creator implies having accepted and being aware of these terms of use.
Creator commitments
  1. Carry out the project in accordance with the characteristics and deadline of the submitted proposal.
  2. Share the works created with the people supporting the project in the manner committed to in the presented project, and provide them with the promised rewards.
  3. Maintain regular contact with the people who support the project.
  4. Grant Aixeta the right of reproduction for informational purposes of the works they have produced, as a sample of their creative track record, and grant consultation rights to the people supporting their project, corresponding to their contributions. The creator retains all other intellectual property rights over the created work.
  5. Notify Aixeta of any incident that affects their creative process.
  6. Inform Aixeta if the work contains adult content so that a warning can be shown to users.
Creator obligations
  1. The Aixeta platform is open to any adult, and also to collectives, whether entities, associations, cooperatives, companies, etc.
  2. The Aixeta platform does not allow political parties constituted as such to create a creator page, nor platforms explicitly affiliated with them (platforms that may have been created under different legal forms and constitutions).
  3. It is mandatory to respect the rights of third parties, with special attention to vulnerable groups and minorities.
  4. It is mandatory to respect the Universal Declaration of Human Rights. Consequently, the content generated and shared on this platform must align with the defense of the rights set out in that declaration.
Aixeta commitments
  1. Ensure that Aixeta creators comply with the points established in the Creator Commitments and Obligations.
  2. Settle monthly the amounts received from patrons linked to each creator within Aixeta, minus 5% (plus VAT) as the commission charged by Aixeta and the fees of the payment gateway, Stripe (explained in more detail on the Frequently Asked Questions page).
  3. Provide the creator with Aixeta platform services, including advice on how to make an attractive page, how to design subscription tiers, and how to promote it effectively.
  4. Promote the platform and all creators on our social media channels, as well as in the press.
Grounds for termination of the collaboration:
  1. Failure to comply with any of the Creator Commitments and Obligations.
  2. Breach by the creator of any of the principles of respect for the rights of third parties established in the second (3) and third (4) points of the Creator Obligations.
  3. The creator does not maintain an ongoing relationship with the people who support the creation.Interruption of the project without justified cause.
  4. Termination of the collaboration will be resolved by Aixeta removing the work from the platform, canceling the project, and informing the creator accordingly.
Plagiarism
The creator will produce an original work. In the event of plagiarism of third party works in any creative modality, the collaboration will be immediately canceled, and the creator will be obliged to reimburse the Association for the amounts received to subsidize the creation that it has paid during the collaboration period.
Liability for claims for damages
The creator assumes responsibility for any claims for damages that third parties may bring arising from their creation, and must indemnify Aixeta for any harm that such claims may cause.
Data management
  • Aixeta complies with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), as well as the Spanish Organic Law on Data Protection and Guarantee of Digital Rights (LOPDGDD).
  • Aixeta will manage the personal data provided in accordance with applicable data protection regulations, committing to the necessary management derived from this creative commitment.
  • At any time, the creator, patron, or subscriber may access the data held by Aixeta and exercise their rights over it.
  • The data, biography, and other information entered by the creator on their page on the platform may be used by Aixeta to promote the creator’s project while the page is active.
  • This data may remain with Aixeta after the page is deactivated. However, the creator may request its removal.

Administrative management
Aixeta will manage the platform by informing the creator of their obligations in order to improve the development of the activity and the relationship with the people who support their work. Although Aixeta will inform them of the tax obligations arising from the contributions they receive, these are the sole responsibility of each creator.
